BUILDING PERMITS

CILA, SCIA, PdC, land registry, APE etc...

Before starting any project, it is essential to clarify the property's status from a regulatory, cadastral, and urban planning perspective. It is not uncommon to encounter unapproved building violations, pending amnesty applications, or buildings constructed differently from the official project plans.

In such cases, it is necessary to check for any irregularities and then apply for the appropriate building permit.

For projects that do not affect structural elements or alter the building’s volume, a CILA (comunicazione di inizio lavori asseverata) is sufficient. This applies to the removal of non-load-bearing walls, the creation of new bathrooms, and property subdivisions or mergers.

If the planned modifications affect the facade or structural elements of the building, a SCIA (segnalazione certificata di inizio lavori) will be required. In more complex cases, such as major renovations involving new volumes or changes in building use, an alternative SCIA to the building permit may be necessary. These cases often require the payment of urbanization fees.

For new constructions or modifications to the shape of protected buildings, the required permit is the PdC (Permesso di costruire).

Once the work is completed, if there has been a redistribution of interior spaces or a change of use, the cadastral records must be updated using the Docfa software, submitting the necessary documentation to the Agenzia delle Entrate.
